This book is largely based on the case law of the European Court of Human Rights and the practices of the European Committee for the Prevention of Torture, particularly regarding the right to liberty, prevention of torture, and combating informal prisoner hierarchies. Moreover, almost in the last days before the publication of this monograph, the CPT published the world’s first special standard dedicated to the phenomenon of informal prisoner hierarchies and the legal basis for combating this phenomenon in penitentiary institutions in European countries[1]. Therefore, with great pleasure, I would like to express my sincere gratitude to Dr. Mykola Gnatovskyy, whose work – first as a member, Vice-President and President of the CPT, and later as a Judge of the ECtHR – has in many ways shaped modern European prison standards and, consequently, influenced my views.
The publication of this book coincides with my term as a member of the CPT elected in respect Ukraine. Naturally, my views on crime, punishment, and the treatment of prisoners have inevitably changed in the course of my work as a member of the CPT. Therefore, I would like to thank Dr. Alan Mitchell, President of the CPT, and all my colleagues, members of the CPT, with whom I have had the honour of working in the noble cause of preventing torture on the European continent. Dieses Buch basiert in vielerlei Hinsicht auf der Praxis des Europäischen Gerichtshofs für Menschenrechte und den Standards des Europäischen Ausschusses zur Verhütung von Folter und unmenschlicher oder erniedrigender Behandlung oder Strafe, insbesondere in Bezug auf die Achtung des Rechts auf Freiheit, der Prävention von Folter und die Bekämpfung informeller Gefängnishierarchien. Kurz vor Veröffentlichung dieser Monografie veröffentlichte der Europäische Ausschuss zur Verhütung von Folter den weltweit ersten Standard zum Phänomen informeller Hierarchien in Haftanstalten und zu den rechtlichen Grundlagen für die Bewältigung dieses Phänomens in Strafvollzugsanstalten in europäischen Ländern[2]. In diesem Rahmen spreche ich Herrn Dr. Mykola Gnatovskyy meinen aufrichtigen Dank aus: Seine Tätigkeit – zunächst als Mitglied, Vizepräsident und Präsident des Europäischen Ausschusses zur Verhütung von Folter und später als Richter am Europäischen Gerichtshof für Menschenrechte – trug maßgeblich zur Gestaltung der modernen europäischen Haftstandards bei; seine Verdienste haben großen Einfluss auf mich.
Die Veröffentlichung dieses Buches fällt in meine Amtszeit als ukrainisches Mitglied des Europäischen Ausschusses zur Verhütung von Folter, was sich auf mein Denken über Straftaten, Strafen und die Behandlung von Gefangenen stark ausgewirkt hat. Der Austausch im Europäischen Ausschuss zur Verhütung von Folter ist für mich überaus anregend: Ich fühle mich geehrt mit dem Präsidenten, Dr. Alan Mitchell, und meinen Kolleginnen und Kollegen zusammenzuarbeiten und bin ihnen zu tiefem Dank für die wertvollen Diskussionen, Gedanken, Ansichten und Ratschläge verpflichtet.

Ця книга багато в чому базується на практиці Європейського суду з прав людини та стандартах Європейського комітету з питань запобігання катуванням, особливо в частині дотримання права на свободу, запобігання катуванням, протидії неформальним в’язничним ієрархіям тощо. Ба більше, майже в останні дні перед публікацією цієї монографії Європейський комітет з питань запобігання катуванням оприлюднив перший в світі окремий стандарт, присвячений феномену неформальних в’язничних ієрархій та правовим основам боротьби з цим феноменом у пенітенціарних установах країн Європи[3]. Тому з великим задоволенням я хочу висловити щирі слова подяки доктору Миколі Гнатовському, діяльність якого – спочатку як члена, Віце-президента і Президента ЄКЗК, а згодом і судді ЄСПЛ – багато в чому сформувала сучасні європейські в’язничні стандарти, а відтак вплинула на мої думки.
Видання цієї книги припало на мою каденцію члена ЄКЗК, обраного від України. Звичайно, що мої погляди на злочин, покарання та поводження з ув’язненими не могли не змінюватися у процесі формування власної практики як члена ЄКЗК. Тому я хочу подякувати доктору Алану Мітчеллу, Президенту ЄКЗК, та усім своїм колегам-членам ЄКЗК, з якими я мав честь працювати у шляхетній справі запобігання катуванням на європейському континенті.
